Management is a Art Series- DAY 2- Constitution-Why it is needed and the first baby step towards creating One!!!!!



Well now that you all are acquainted with the interesting history of how constitution came into being... Now time has come that we study to to create a efficient just,workable and user friendly constitution for any company or organization ....Then??


What is a constitution for a Company or organization?????


Let’s explain this in a very simple manner, a constitution of a company or organization is simply a set of written rules or an agreement governing the aims of your organization, how it will be run and how the members will work together with a sense of justice and fairness  Because, without a written understanding, people may become confused and things may not get done; - it will act as a point of reference and help resolve any problems or controversy that may arise in present or future.

 It reassures the employees and employers ,that your professional day to day life  is properly run and for owners money,manpower,material,process and infrastructure is effectively managed, earned ,saved and ensuring an optimum quality output; - it illustrates that Company/Organization  is democratic and accountable, with clear methods by which decisions are made and the main focus here is that company cares for its employees and could like to have a symbiotic long term relationship with them.

Every constitution is different and should accurately reflect the mindset, goals, and aim of that particular company or organization, so never make the mistake of blindly copying and pasting...Each organization is different as each child in a classroom. One must understand one’s organization and customize the constitution accordingly …I say this because I have seen how Managing directors of so called companies are just twiddle Some and twiddle Dee…… And they just want to ape the brands without realizing that they are creating chaos for their own organization…

Ok!!! Now what next… Build a team that is heavily invested in the process and its outcome…

How???

Bring together, your various colorful personalities, best minds, worst minds, creative people –at your conference table …don’t forget to instruct the house keeping to supply endless cups or glasses of beverages and snacks …keep them in a good humor, first explain clearly the purpose of this brain storming meeting and what you expect from them…ask them to clear their doubts if they have any… Keeping the rules simple is also a priority….don’t complicate things and language…being too technical in languages and using jargons is an outdated technique to show your superiority…

Be Simple, sweet, humorous ,gentle but firm  …then leave them to their devises… Should leaders be at the table? Leaders are the ultimate deciders, but they may stay outside the deliberations so that they may be brought in as conflict mediators whenever the storms arise….


So we are still at the foundation and we will be slowly but steadily build up the concept of constitution, hope of enjoyed today’s blog??? Let me know… Bye, Tc see you tomorrow…

Management is a Art Series- DAY 1- Constitution!!!-Base and History


Let us first Understand the term" Constitution",well Constitution is a set of laws in a written form,All other laws in the company/Organization must follow the Constitution, but the constitution does not replace these laws. Instead, it sets out the standards, which they must follow. Think of it as the foundation of a house - all other laws are like the doors, walls, windows and roof. When you build a house, what it looks like will depend on what the foundations are. So too, all the other laws in the company depend on what the Constitution says,it sets out the structure and type of SOPS we must follow and what powers they have so Constitution is a base,its a base foundation on which a company or organization is build.

 It makes sure that your rights are protected and sets up institutions to ensure that the Company and Company officials do not abuse your rights and you do not take the company for granted,at any time citing your friendships or special settings( emotional,Physical or friendly) to those at higher positions in the company

Constitution sees to it that everyone follows established and recognized rules rather than yielding to arbitrary or irrational actions and decisions as I said above on friendships- Physical-where officials are involved in affairs with each other,Emotional- where officials are buddies with each other or Friendly- where officials are influenced by mutual family friends,relatives etc . If there were no Rule of Law there would be anarchy and confusion, so a Constitution not only assures justice,fairness but also protects each from injustice and promotes legal fairness,even the company/organizational ownership cannot change it to benefit themselves.

Before going deep into the concept of Constitution,lets us acquaint ourselves with its history in short: 

First lets revile as how old is the concept of the constitution

It is said that,the first written set of laws was the Hammurabi-was the ruler who chiefly established the greatness of Babylon, the world's first metropolis. Many relics of Hammurabi's reign ([1795-1750 BC]) have been preserved, and today we can study this remarkable King....as a wise law-giver in his celebrated code.....

By far the most remarkable of the Hammurabi records is his code of laws, the earliest-known example of a ruler proclaiming publicly to his people an entire body of laws, arranged in orderly groups, so that all men might read and know what was required of them. The code was carved upon a black stone monument, eight feet high, and clearly intended to be reared in public view. This noted stone was found in the year 1901, not in Babylon, but in a city of the Persian mountains, to which some later conqueror must have carried it in triumph. It begins and ends with addresses to the gods.

 Even a law code was in those days regarded as a subject for prayer, though the prayers here are chiefly cursings of whoever shall neglect or destroy the law.The code then regulates in clear and definite strokes the organization of society. The judge who blunders in a law case is to be expelled from his judgeship forever, and heavily fined. The witness who testifies falsely is to be slain. Indeed, all the heavier crimes are made punishable with death. Even if a man builds a house badly, and it falls and kills the owner, the builder is to be slain. If the owner's son was killed, then the builder's son is slain. We can see where the Hebrews learned their law of "an eye for an eye." These grim retaliatory punishments take no note of excuses or explanations, but only of the fact--with one striking exception. An accused person was allowed to cast himself into "the river," the Euphrates. Apparently the art of swimming was unknown; for if the current bore him to the shore alive he was declared innocent, if he drowned he was guilty. 

So we learn that faith in the justice of the ruling gods was already firmly, though somewhat childishly, established in the minds of men.

 Although recent archaeological finds have scholars questioning whether others may have actually predated it.

One of the predated constitution which was believed to be the Ten Commandments

 The Ten Commandments is the constitution which God himself gave it to Prophet Moses and Mosaic Law are the oldest written set of law still observed today, although on a religious rather than governmental level.

The Ten Commandments were spoken to Moses in God's own voice and then later written on two tablets of stone by the very finger of God. They are extremely important to God. After Moses destroyed the tablets inscribed by God, he made Moses write new ones, just like the ones he had written himself.
 The Ten Commandments are the first part of God's law system. In essence, they are a summary of the hundreds of laws found in the Old Testament Law. They offer basic rules of behavior for spiritual and moral living. They were designed to guide Israel into a life of practical holiness. These laws still instruct us today, for they expose sin and show us God's standard. 


Then we have this fact too,that first document called a constitution was written in the Greek city-state of Athens.

 it was called the Solonian Constitution, around 600 B.C.. 300 years after that document was written Aristotle{Ancient Greek philosopher Aristotle was born circa 384 B.C. in Stagira, Greece. When he turned 17, he enrolled in Plato’s Academy. In 338, he began tutoring Alexander the Great. In 335, Aristotle founded his own school, the Lyceum, in Athens, where he spent most of the rest of his life studying, teaching and writing. Aristotle died in 322 B.C., after he left Athens and fled to Chalcis.} was the first to define Constitutionalism and differentiate between ordinary laws and having a constitution.


So people since ancient times are coming up with constitution for their country,company,organization etc so that the main purpose-was/ is a better management ....

We will discuss in detail- in blog DAY- 2 tomorrow ..Today I just wanted to give a brief Idea as to what constitution is and how is is must for every company- big or small......
